Driving under the influence of drugs or alcohol is illegal in all 50 states. The driver’s blood alcohol content may vary from state to state, but there are laws in place to prevent DUI crashes and deaths from happening. Offenders, of course, have the option to defend themselves in court and often hire an attorney who has experience in such cases.
If you don’t have counsel or know one, it’s a good idea to talk with friends and relatives who can give recommendations. The laws vary from state to state; so make sure the DUI attorney you hire is licensed in the state the offense occurs. If you are placed under arrest and charged with driving under the influence, it’s important to ask the attorney what will become of your driver’s license. In some cases an attorney can prevent it from being revoked, but depending on the history of the defendant, that may not be an option.
It’s possible to settle a driving under the influence case out of court. The prosecutor may be willing to work out a plea deal to avoid the time and expense of a trial. This is dependent upon the history of the offender and the caseload of the court system.
Some attorneys can work it out, so the DUI is expunged from the driver’s record. It requires work and a lot of money to remove such charges. Some states won’t even allow it to happen, but be sure to discuss the option with the attorney.
Be sure to ask about the attorney’s expense with driving under the influence cases. Understanding the lawyer’s track record and history can determine if this is the best person for the case. Another factor to consider is the cost. Be sure to ask about attorney’s fees and other costs involved in a DUI case. Many times the attorney will work off either a flat fee arrangement or an hourly rate based on the case. Their level of experience will also play a factor in this deal. Costs may be high, and if so, some attorneys are willing to negotiate the fees involved.
The best way to remain out of court is, of course, to never drive under the influence in the first place. Always designate a driver or call for a ride home if you’ve had too much. Your life and the lives of other innocent people are at stake.
